Daymark Health Inc, and its affiliates (collectively, “Daymark Health,” “we,” “us,” or “our”) are committed to respecting your privacy and your privacy choices. This Privacy Policy (“Policy”) describes how we collect, use, and disclose personal information that we receive directly from you, or that we collect through your use of this website, daymarkhealth.com (“Site”), and other Daymark Health related services (collectively, our “Services”).

All users (“user(s),” “you,” or “your”) should read this Privacy Policy carefully. Users should understand their right with respect to the information we collect through your use of the Services.  If you do not agree to be bound by this Privacy Policy, then do not access or use the Services.  By accessing and/or using the Services, you accept and agree to be bound by this Privacy Policy.  This Privacy Policy is incorporated into our Terms of Use. Your use of our Services and any Personal Information (as hereafter defined) you provide through the Services, virtual or in-person, are subject to this Privacy Policy at all times.

PLEASE NOTE THAT THIS PRIVACY POLICY DOES NOT APPLY TO YOUR PROTECTED HEALTH INFORMATION. We may receive your Protected Health Information (PHI) when you, for example, choose to share your PHI when submitting an inquiry through the patient contact form on our website. Protected Health Information is subject to protection under the Health Insurance Portability & Accountability Act of 1996 (“HIPAA”) and treated in accordance with the Notice of Privacy Practices. 1.  Personal Information and What We Collect

“Personal Information” is used as a general term and means any information that identifies, relates to, describes, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular User or their household.

When you access or use the Services, you may provide Personal Information to us, such as when you request to receive information or support; complete online forms and surveys; communicate with us or our representatives, whether through standard mail, email, or telephone.

From You: We may collect Personal Information about you when you provide it directly to us, when you interact with the Site or utilize the Services, and when other sources provide it to us, such as:

  • Registration Information: when you register for the Services or an eligibility check to receive services, you provide us with information such as your name, date of birth, address, and other contact information (e.g., phone number and email);

  • Self-Reported Information: information you provide to us when responding to surveys, or through communications with us including through mail, email, telephone, or texting;

  • Employment Information: information such as your resume, employment history, educational history, qualifications, references, demographics, and equal employment opportunity information you voluntarily provide us;

  • Financial Information: information you voluntarily provide us about your finances so that we may help with patient assistance or other financial support services.

  • User Content: any information data, text, software, music, audio, photographs, graphics, video, messages, or other materials other than Self-Reported Information that you create and send to us, whether publicly or privately when using our Services. This includes Comments posted on Community Support Blogs or messages you send through use of our Services.

 From Third Parties: We work with and may receive your personal information from third parties such as service providers, vendors, contractors, or referring providers, health insurers, and other business partners.

From Use of Our Services: We collect information about your visits and use of our Services including through use of web-behavior technology and cookies.

  • Web-behavior Information: Information on how you use our Services or about the way your devices access our Services is collected through log files, cookies, web beacons and other technologies. This information includes for example: device information, IP address, browser type, your browsing history and page views, websites you visited before entering or leaving the Site, and your interaction with other content on the Site.

  • Limited Geolocation Information: You may choose to allow us to access your location by granting the Site access to your location when prompted or through your device’s location services settings. You may change these settings on your device, but this will impact your use of and access to the Services.

From Cookies: A "cookie" is a small text file that may be transferred and stored on your computer’s hard drive to personalize your experience and gather information about how you use our Services.

Sometimes, we may also combine your cookies information with other personal information we obtain about you, or with other information we may obtain from third parties.

Information we collect about you may be aggregated with other users’ Information. It may also be combined with associated Personal Information that you provide to us or that we receive from third parties.  If we combine or associate information from other sources with Personal Information that we collect through the Site, we will treat the combined Information as Personal Information in accordance with this Policy.

 

3. How We Share Your Information

While we do not “sell” your information, we may, from time-to-time and without additional notice, share your personal information with certain third parties as provided below: 

  • ​Our service providers: Our service providers help us administer and provide the Services (for example, a web hosting company whose services we use to host our platform). This also includes site analytics, cloud storage, certain marketing purposes, and customer support. These third-party service providers have access to your Personal Information only for the purpose of performing services on our behalf.

  • Commonly owned entities, affiliates, changes in ownership: We may share your personal information with affiliated entities, including parent, subsidiary, or affiliate organizations that enable us to provide the Services, and which entities are required to treat the information in accordance with this Privacy Policy. We may also share your personal information in the event of a change in ownership or control, such as a sale, merger, or bankruptcy proceeding.

  • Your authorized third parties. We share your personal information with parties that you directly authorize to receive your information, as permitted by law. The use of your Information by an authorized third party is subject to the third party’s privacy policy.

  • As we believe necessary: (i) under applicable law; (ii) to enforce applicable terms and conditions; (iii) to protect our rights, privacy, safety or property, and/or that of our affiliates, you, or others; (iv) to detect, prevent, or otherwise address fraud, security or technical issues; (v) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third party which has been posted or transmitted without their consent or as a form of harassment; and (vi) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include authorities outside your country of residence.

 

4. Your Rights and Choices

You also have rights and choices when it comes to how we use or share your personal information. The following are ways you may exercise those rights or make certain choices about how we use your personal information:

  • Access or Update Your Information. If you have registered for an account with us, you may request to review and request update of certain personal information in your account profile by emailing us at support@daymarkhealth.com.

  • Text message communications. Eligible Daymark users over the age of 18 may choose to opt-in to participate in Daymark Health’s Text Message Program . You may opt-in when you initially speak with a Daymark representative or a Daymark Provider, by visiting our Site and submitting the Daymark Health SMS Opt-In, or by making any other Service request and agreeing to the terms of the Daymark Text Message Program. Message frequency will vary. Normal messaging rates apply. We do not communicate with you via text messages for Marketing purposes or share your mobile information with third parties for marketing purposes. Mobile Carriers are not liable for delayed or undelivered messages. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

  • Opt-out of text message communications. You may opt-out of text messaging at any time by replying to any message with STOP or by contacting us at support@daymarkhealth.com. After you send the text message "STOP" to us, we may send you one final text message to confirm that you have been unenrolled. If you have opted-in to receive more than one type of text message from Daymark, you will need to opt-out of each Daymark text message type to which you are enrolled. Until you have done so, you may continue to receive the types of text messages from Daymark that you have opted-in to receive, but have not unenrolled from.

  • Opt-out of marketing communications. You may opt-out of receiving marketing-related emails by following the “opt-out” or “unsubscribe” instructions at the bottom of the email, or by contacting us at support@daymarkhealth.com. Although you opt-out, you may continue to receive Service-related and other transactional, non-marketing emails.

  • Cookies. Most browser settings let you delete and reject cookies placed by websites. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, you may not be able to use all functionality, or things may not work when you attempt to use the Services.   • How can you delete the data we collect from you? Based on the laws of some countries, you may have the right to request access to the personal information we collect from you, change that information, or delete it in some circumstances. To request to delete your personal information, please submit a request by emailing support@daymarkhealth.com. We will respond to your request within 30 days.

  • Choosing not to share your personal information. Where we are required by law to collect your personal information, or where we need your personal information in order to provide the Service to you, if you do not provide this information when requested (or you later ask to delete it), we may not be able to provide you with our Services. We will tell you what information you must provide to receive the Service by designating it as required at the time of collection or through other appropriate means.

 

5. Online Advertising Choices & Do Not Track Signals

The Services may integrate with third-party advertising technologies (e.g., ad networks and servers such as Facebook, Google Ad Words and others). You can limit use of your information for interest-based advertising by:

  • Adjusting your browser settings. Blocking third-party cookies in your browser settings.

  • Using Privacy browsers/plug-ins. By using privacy browsers or ad-blocking browser plug-ins that let you block tracking technologies.

  • Opting out by using Ad industry tools. Opting out of interest-based ads from companies participating in the following industry opt-out programs:

You will need to apply these opt-out settings on each device from which you wish to opt-out.

Notices Concerning Do Not Track Signals. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. 6. Links to Third Party Sites

Our Site may contain links to other sites that are not owned or operated by us.  If you click on a link to another site, you will be directed to that third party’s site.  Inclusion of these links in our Services do not constitute any endorsement by us of those other websites, their content, services, privacy policies, or the persons or entities associated with those websites.

7. Children's Privacy

While Daymark Health provides healthcare services to patients of all ages, including children under the age of thirteen (13), our website and online services are intended for use by parents, guardians, and adult patients. In accordance with the Children's Online Privacy Protection Act ("COPPA"), we will never knowingly collect Personal Information through our website from children under the age of thirteen (13) without verifiable parental consent.

When providing healthcare services to children under 13, we collect and maintain their Protected Health Information (PHI) in compliance with HIPAA and other applicable healthcare privacy laws, with appropriate authorization from parents or legal guardians. However, all online interactions, appointment scheduling, and account management for minor patients must be conducted by a parent or legal guardian.

If we receive actual knowledge that we have collected Personal Information through our website from a child under 13 without verifiable parental consent, we will delete that information from our database as quickly as is practical. We reserve the right to request proof of age at any stage to verify that minors are not using our online services without parental involvement.

 

8. Information Security

We take a variety of technical and organizational measures to safeguard the Personal Information that you provide to us. However, it is common knowledge that no method of transmission over the Internet, and no means of electronic or physical storage, is absolutely secure. As such, you acknowledge and accept that we cannot guarantee or warrant the security of your Personal Information, or any other information, transmitted to or through use of our Site, Services, or otherwise provided to us, and such use or transmission is at your own risk.  We are not responsible for the theft, destruction, or inadvertent disclosure of such information. Consistent with our Terms of Use, it is your responsibility to safeguard any passwords, ID numbers, or other special access features associated with your use of the Services.  Any transmission of information is at your own risk. If you have any questions about security on our Services, or if you become aware of or suspect a security breach, notify us immediately via email at support@daymarkhealth.com.  If our security system is breached, we will notify you of the breach to the extent required under applicable law.

We keep your Information as described in this Privacy Policy for as long as you use our Site or as it is necessary to fulfill the purpose(s) for which the Information was collected, to provide our products and services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and/ or as to comply with applicable laws.

 

10. Your California Privacy Rights

California Civil Code Section 1798.83 permits California residents to request and obtain a list of what Personal Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge.  Under Section 1798.83, California residents are entitled to request and obtain such information, by e-mailing a request to hello@daymarkhealth.com.

 

11. Revisions to Our Privacy Policy

We reserve the right to change this Privacy Policy at any time to reflect changes in the law, our data collection and use practices, the features of our Services, or advances in technology. We will make the revised Privacy Policy accessible through the Services, so you should review it periodically. The date this Privacy Policy was last revised is identified at the top of the document. You are responsible for periodically monitoring and reviewing any updates to the Privacy Policy. If we make a material change to the Privacy Policy, we will provide you with appropriate notice in accordance with legal requirements.
